4.1. Our Services operate on a token-based system with one-time purchases processed through Tebex. By purchasing tokens, you agree to pay all fees according to our current pricing.

4.2. No Refunds: All purchases are final and non-refundable. No refunds will be issued for unused tokens, partial use, or non-use of the Services.

4.3. Tokens do not expire, but we reserve the right to modify our token system with reasonable notice.

4.4. Pricing may change at any time. Changes will be reflected on our pricing page and apply to future purchases.

5. INTELLECTUAL PROPERTY AND CODE OWNERSHIP

• Marketplace Restrictions: Some marketplaces (including BuiltByBit) prohibit AI-generated content. You are responsible for verifying marketplace policies before selling

Codella AI retains all rights to our platform, AI models, algorithms, and underlying technology. This includes all software, interfaces, and proprietary systems used to provide the Services.

5.3. License to Use

By using our Services, you grant us a limited license to access, store, and process your User Content solely to provide the Services, including technical support and platform improvements.

6. DATA USAGE AND PRIVACY

6.1. Data Storage: Your projects and data are stored on MongoDB Atlas cloud servers located in Europe and the United States.

6.2. AI Training: We may use customer code and interactions to train and improve our AI models. This helps enhance the quality and capabilities of our Services.

6.3. Data Retention: Projects and associated data are stored indefinitely but may be deleted after 6 months of account inactivity at our discretion.

7. AI MODELS AND DISCLAIMERS

7.1. Available Models: Our Services provide access to various AI models including Deepseek, Claude, ChatGPT, and Grok.

7.3. No Guarantees: We do not guarantee that AI output will be unique, error-free, or suitable for your specific purposes.

8. PROHIBITED CONTENT AND CONDUCT

You agree not to use our Services to create, generate, or distribute:

12. MARKETPLACE SALES

12.1. You may sell AI-generated content on marketplaces where such sales are permitted.

12.2. You are solely responsible for verifying marketplace policies regarding AI-generated content.

12.3. We are not liable for marketplace policy violations or restrictions on AI-generated content sales.

13. DISCLAIMERS

13.1. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

13.2. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

14.3. WE ARE NOT LIABLE FOR ISSUES RELATED TO AI-GENERATED CODE, INCLUDING BUGS, SECURITY VULNERABILITIES, OR COMPATIBILITY PROBLEMS.

15. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Codella AI from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

16. TERM AND TERMINATION

16.1. These Terms remain effective until terminated by either party.

16.2. You may terminate by ceasing use and deleting your account.

16.3. We may terminate your access at any time for any reason.

16.4. Upon termination, your right to use the Services ceases immediately.

17. MODIFICATIONS

We may modify these Terms at any time. Changes become effective upon posting. Continued use constitutes acceptance of revised Terms.

18. GOVERNING LAW
